Affiliate Program Terms & Conditions

These Terms & Conditions apply to participants in the Smart Real Estate Coach® Affiliate & Referral Program (“Program”).
By enrolling, you (“Affiliate”) agree to the following terms and conditions with Wicked Smart LLC d/b/a Smart Real Estate Coach (“Company”).

1. Definitions and Interpretation

  • 1.1 In these Terms & Conditions the following terms shall have the following meanings:
  • “Affiliate” means any approved participant in the Program.
  • “Company” means Wicked Smart LLC d/b/a Smart Real Estate Coach®.
  • “Business Day” means any day other than Saturday, Sunday, or a U.S. federal holiday.
  • “Commission” means the percentage of sale proceeds earned on qualifying product sales.
  • “Cookie Duration” means the 60-day tracking period after a visitor clicks the Affiliate’s referral link.
  • “Associate Upgrade Bonus” means the $2,000–$2,500 bonus defined in Section 4.
  • “Bill.com” means the Company’s preferred payment platform for processing Affiliate payouts.
  • “Term” means the period during which the Affiliate participates in the Program.
  • “Cancellations Policy” means our refund and cancellation policy available at smartrealestatecoach.com/refundpolicy

2. Enrollment in the Program

  • By enrolling in the Program, you agree to provide accurate registration details and keep them up to date.
  • Approval is at the sole discretion of the Company. Once accepted, you’ll gain access to your Affiliate Dashboard, where you can track links, referrals, and commissions.
  • The Company reserves the right to approve or reject any application at its sole discretion, including where an Affiliate’s marketing practices or website content may conflict with Smart Real Estate Coach® brand standards or values.

3. Commission Structure

  • Affiliates earn a 50 % commission on all eligible product sales tracked through their unique referral link.
  • Commissions apply to net sales (excluding refunds, chargebacks, and taxes).
  • Cookie Duration is 60 days from the first click.
  • Commissions become payable 45–60 days after the customer’s payment to allow for the 30-day money-back guarantee period.

4. Associate Upgrade Bonus

  • Affiliates may receive a bonus of $2,000–$2,500 if a referred student upgrades to a higher Associate level within 12 months of their initial opt-in.
  • If no Apprentice-level commission was previously paid, the bonus is $2,500.
  • If a commission was already paid for that student’s Apprentice-level enrollment, the bonus is $2,000. Bonuses are paid 15–30 days after the first payment of the upgrade is received by the Company.

5. Payment Process

  • All Affiliates must submit a completed IRS Form W-9 to affiliate@smartrealestatecoach.com before receiving payment.
  • Once received, the Company will invite the Affiliate to Bill.com for electronic payments.
  • Paper checks can be issued upon request after receipt of the W-9.
  • Affiliates are solely responsible for any taxes owed on commissions or bonuses.

6. Event Travel and Referral Bonuses

  • If a REIA or Affiliate hosts an event where Smart Real Estate Coach® is a speaker and the event requires travel, the first $1,000 in revenue generated from that event will reimburse travel expenses. Any remaining net revenue will be shared as mutually agreed, unless travel is covered by the event host.
  • Additional event-referral bonuses may be available; Affiliates may contact affiliate@smartrealestatecoach.com to discuss details.

7. Affiliate Responsibilities

  • Promote Company products honestly and ethically in compliance with FTC endorsement guidelines and applicable laws.
  • Use only approved marketing materials or those authorized by the Company.
  • Do not run paid ads on Company brand names or register confusingly similar domains.
  • Do not use spam, deceptive advertising, or unethical practices to generate referrals.
  • Do not copy or alter Company logos, banners, or course content without written approval.
  • Maintain professional conduct that aligns with Smart Real Estate Coach® values.

8. Audit Rights

The Company may, with five (5) Business Days’ written notice, audit Affiliate records related to commission calculations to verify accuracy.
If an audit reveals material discrepancies, the Affiliate will reimburse the difference and related audit costs.

9. Relationship of Parties

  • The Affiliate acts as an independent contractor, not an employee, agent, joint venturer, or partner of the Company.
  • Affiliates have no authority to enter contracts, make representations, or assume obligations on behalf of the Company.

10. Confidentiality

  • Affiliates agree to maintain the confidentiality of all non-public information received from the Company, including pricing, strategy, and customer data.
  • This obligation continues after termination of the Agreement.

11. Data Privacy

  • The Company does not sell or share Affiliate data with third parties except as necessary for tax compliance or payment processing (Bill.com).
  • Data is handled in accordance with the Company’s Privacy Policy.

12. Termination

  • Either party may terminate this Agreement by written notice.
  • Commissions accrued before termination will be paid if eligible.
  • Confidentiality and payment obligations survive termination.
  • The Affiliate may not assign this Agreement without the Company’s written consent.

13. Governing Law

  • This Agreement is governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles.
  • Any disputes shall be resolved in Rhode Island courts.

14. Entire Agreement and Contact

  • This document constitutes the entire agreement between the Affiliate and Smart Real Estate Coach® and supersedes all prior versions or communications.
  • Failure by either party to enforce any provision shall not constitute a waiver of that provision.
